Football in pubs ruling upheld by the High Court

The legal ruling by the European Court of Justice earlier this year has been upheld by the highest court in England, meaning that pub landlady Karen Murphy can use her Greek satellite decoder to show any football match she likes to her customers.

The Independent reports today (see Pub landlady Karen Murphy wins High Court case - The Independent ) that

"It was conceded in the High Court today that Karen Murphy's appeal over using a cheaper Greek decoder in her Portsmouth pub to bypass controls over match screening must be allowed."

and that Karen Murphy said outside court that:

"It's a moral victory," she added. "This was big corporations thinking they are above the law."

This follows the ruling Broadcasting territorial exclusivity with a decoder card is contrary to EU law from the European Court of Justice, following the notice given 12 months ago, Karen Murphy scores against the Premier League and Sky.

The paper also reports that:

Mrs Murphy, who ran The Red, White and Blue pub in Portsmouth, Hampshire, said she believed she had won "90%" of the battle.

But the Premier League claimed a partial victory, after the ECJ said it maintained the copyright for some sections of the broadcast.

The "some sections of the broadcast" are the theme music played before and not specifically any part of the actual game.

Hi,

Does anyopne know ... If I buy a secondhand sky box, and attach it to a disk in France, will I get english TV? Also, can someone explain what a sky card is and would I need one in france?

Jinny: From what I understand you will only get a limited number of channels if any. To use a sky box anywhere you need a freesat card for the sky box to enable it to pass thru the freesat channels. You pay for this card.
If you buy a freesat box which is not tied to sky you will receive at least 40 channels+ without needing a card. Sky can always change their stance and block these freesat cards.
Go with a freesat box I have and its great.

Jinny: The "card" provides only access to the PICK TV channel (and +1). You can remove the card and still watch Freesat from Sky.

Actually the card does also provides access to Channel 5 HD. The Sky EPG also has some FTA channels not on Freesat.

It looks as though the Premiere league are going to have rethink the way they sell thier television rights. The ruling that live football itself is not copyrightable is interesting.

Trevor Harris: Yes, it would appear that the EPL people are going to have some thinking to do.

The point about "live football" not being copyrightable is that it is not a creative act, but an (unpredictable) event that is happening.

On Saturday afternoon I turned my satellite dish to pick up Eutelsat W3A at 7.0°East. Flicking through the channels I came across GRTS, a Gambia channel, that was showing the football match between Chelsea and Bolton free-to-air. It was widescreen with the English commentary, although the picture was slightly less than UK standard definition. At least I watched it without adding to the Murdoch coffers.
