Mike Dimmick: I suspect that if Ofcom had made changes to the terms of the licence during the licence period (rather than now, at the end), they would have been threatened with a judicial review and so the lawyers would have probably advised against it.

I have to say I am somewhat concerned that operator licences are getting rolled-over automatically.

The relationship between Ofcom and Arqiva is very troublesome here, in particular.

Arqiva own the two multiplexes, and they also own all of the masts - New transmitter monopoly | ukfree.tv - independent free digital TV advice - it would be so uneconomical for another company to construct over 80 new masts to run the multiplexes independent from Arqiva, and Ofcom seems to use Arqiva for "independent advice".

This is a very troublesome situation, as the market is supposed to sort out these problems, but the regulator and monopoly company seem to be sleeping with each other (to mix metaphors for a moment).

Steve P: Section 134 of the Communications Act 2003 sets out the principle "that no person should unreasonably be denied access to an electronic communications network or to electronic communications services."

Lelpep: I count 99 listed at the top of the page, so add on Sky Sports 1, Sky Sports 2, ESPN and G.O.L.D and that's 103.

If you had a larger number before it was probably because you had not cleared your list before you scanned and "old duplicates" were being listed.

Anyone who seems unable to get Freeview HD from the Lichfield transmitter - can you please see if you can also receive Channel 5 on analogue from the transmitter? Thanks.

Mark A.: I'm still amazed that people think that the TV Licence pays for anything other than the BBC channels, even though I did state it in the article and everything.

I'm curious as to why you thought that?

Mike Dimmick: I'm not sure if any of the things you have linked to, especially the "Adjudicator for Broadcast Tranmission Services" makes me think that there is anything other than a large helping of corporatism going on here.

It is hard to see how Ofcom creates a market when they allow players to have their own way, particular examples other than the Arqiva merger was allowing the "DRM light" on Freesat and the roll-over of the "Channel 3 Licences".

I also note that no-one at Ofcom has got back to me yet over the points raised on the EXCLUSIVE More Freeview capacity coming 2012-2016 | ukfree.tv - independent free digital TV advice page, and they usually do.

I'm not making accusations, but I'm just saying it smells fishy.
